These Terms of Service ("Terms") form a binding agreement between you and Ryan Countiss, an individual doing business as NxtQue ("NxtQue," "we," "us," or "our"), governing your access to and use of the NxtQue website at nxtque.com and our related services (the "Service").
NxtQue is operated by Ryan Countiss, an individual sole proprietor located in Maryland, doing business under the trade name "NxtQue." Contact: support@nxtque.com.
You must be at least 18 years old to create a NxtQue account. By using the Service, you represent that you are 18 or older, have the legal authority to enter into these Terms, and (if signing up on behalf of a business) have the authority to bind that business.
NxtQue offers a free trial. After the trial, continued use of paid features requires a subscription. Plans, pricing, and feature availability are described on our Pricing page. We may add, remove, or change features and plans from time to time.
Subscriptions are billed in advance through Stripe. By subscribing, you authorize us (through Stripe) to charge your payment method on a recurring basis. You're responsible for keeping your payment information current. If a charge fails, we may suspend or downgrade your account.
Subscription prices do not include taxes unless explicitly stated. You are responsible for any sales, use, value-added, or similar taxes that apply to your purchase.
Refund policy: if you cancel within the first 14 days of a paid subscription, we will provide a pro-rated refund for the unused portion of that billing period. After the first 14 days, payments are non-refundable. You may cancel your subscription at any time — your account will remain on the paid plan until the end of the current billing period, after which it will not renew.
Cancellations take effect at the end of the current billing period. Cancelling does not refund the current period (except as described above).
Some features rely on third-party services (such as SMS via Twilio). We may pass through usage fees from those providers, or include reasonable allowances within your plan. Any such fees will be disclosed on the Pricing page or before they're charged.

We may suspend or terminate accounts that violate these rules, with or without notice.
You retain ownership of the content you submit to NxtQue — your name, bio, photos, services, prices, portfolio images, and so on ("Your Content"). By submitting Your Content, you grant NxtQue a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute it solely as necessary to provide the Service to you and your customers.
If you claim a personal handle (e.g., nxtque.com/@yourname), your profile page is publicly accessible. Anything you put on it — cover photo, bio, portfolio, services with prices — can be viewed and shared by anyone with the URL.
When customers book with you through the Service, you may receive their name, phone number, and other booking details. You agree to handle that information responsibly: use it only for the booking and related communication, do not resell it, do not send promotional messages outside what they've consented to, and comply with applicable privacy and anti-spam laws.
You are solely responsible for Your Content and for the legality of any service you advertise through NxtQue. We do not pre-screen content. We may remove content that violates these Terms, applicable law, or another party's rights.
The Service itself — including its software, design, branding, name, and logo — is owned by NxtQue and protected by U.S. and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. We reserve all other rights.
The Service depends on third-party providers, including Stripe (payments), Twilio (SMS), GoDaddy (hosting), and the calendar providers you subscribe to (Google, Apple, Microsoft). Those services have their own terms and privacy policies. We're not responsible for their actions or inactions, but we'll do our best to fix issues that affect you.
You may stop using the Service at any time. We may suspend or terminate your account if you violate these Terms, if your payments fail and aren't resolved, or if we discontinue the Service. We'll generally give you notice and a chance to fix the issue first, except in cases involving security, fraud, or serious harm.
Upon termination, your right to use the Service ends. Provisions that by their nature should survive (intellectual property, disclaimers, limitations of liability, dispute resolution) will survive.
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied. To the maximum extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, error-free, secure, or meet your requirements.
NxtQue is a tool that helps you manage bookings and queues. We don't guarantee that your business will succeed, that customers will book through us, or that the Service will be available at any particular moment.
To the maximum extent permitted by law, NxtQue (Ryan Countiss) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or in connection with your use of the Service — even if we've been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or relating to the Service is limited to the amount you paid us in the twelve months immediately before the event giving rise to the claim, or one hundred U.S. dollars ($100), whichever is greater.
You agree to defend, indemnify, and hold harmless NxtQue (Ryan Countiss) from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of: (a) your use of the Service in violation of these Terms or applicable law; (b) Your Content; (c) your interactions with your customers; or (d) any SMS or other communications you send through or because of the Service.
These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Maryland, and you consent to the jurisdiction of those courts.
Before filing a formal claim, you agree to contact us first at support@nxtque.com so we can try to resolve it directly.
We may update these Terms from time to time. When we do, we'll revise the "Last updated" date at the top. Material changes will be communicated through the Service or by email. Your continued use of NxtQue after a change means you accept the updated Terms.
